This list considers the position of judicial precedent as a law-enforcement standard and focuses on the analysis of the status of case law in key jurisdictions. Reveals the need for judicial practice in the manufacture of cases on similar issues and recognize the source of law. Lots of situations in the judicial process requires a thorough analysis of legal principles and arguments that are needed for use in making the right decisions on specific cases. This is facilitated by years of accumulated jurisprudence of national and foreign law. Currently in the «common law» judges are mainly engaged in the interpretation of statutes, and their activities, thus, are associated with enforcement. Judicial interpretation of the statute is, in turn, set a precedent, but the so- called «precedent of interpretation» and the current case law largely developed through case law interpreting as acts based on law rather than «pure» cases. The judicial precedent exists in many countries. In some jurisdictions, it fades into the background, while in
others, by contrast, gets a new development. The flexible nature of the case law allows him to adapt to a variety of cultural, historical, political and other conditions. This versatility allows different legal systems retsipirovat judicial precedent as a source of law. Doctrine of judicial precedent is very important for the court proceedings and is to make a fair general law. The judges in their decisions use previous decisions made by other courts meanwhile making decisions in these or similar cases. This creates a fair and gives confidence in the law.
