Нормативно-правове регулювання пам’яткоохоронної діяльності в радянській Україні (1928–1933 рр.)

Abstract

У статті досліджено тенденції, що призвели до істотних змін у галузі охорони історико-культурного надбання в 1928–1933 рр. Зокрема, розглянуто уплив антирелігійної політики радянської влади, «Великого перелому» та подальшої ідеологізації суспільно-політичного життя на пам’яткоохоронну сферу. Простежено спроби профільних структур та окремих їх співробітників на законодавчому рівні убезпечити надбання минулих епох від знищення. Метою дослідження є виявлення основних тенденцій становлення профільної нормативно-правової бази в контексті загальнорадянських процесів у 1928–1933 рр. Методи дослідження. Для досягнення поставленої мети використані проблемно-хронологічний, історико-порівняльний та історико-генетичний методи. Методологічною основою дослідження є полідисциплінарний підхід. Для вивчення «історичної політики» застосований культурологічний підхід, а для вивчення законодавства – порівняльно-правовий аналіз. Наукова новизна статті полягає в тому, що досліджені в ній матеріали дозволяють краще проаналізувати передумови появи кризових явищ у пам’яткоохоронній сфері радянської України (1928–1933 рр.) крізь призму вивчення «історичної політики», визначити особливості охорони пам’яток в УСРР у загальнорадянському контексті. Висновки. Було з’ясовано, що спроби на законодавчому рівні убезпечити пам’ятки минулого в 1928–1933 рр. були безуспішними через цілу низку чинників. Зокрема, найбільш виразний негативний вплив на становище пам’яток минулого мали тенденції до посилення антирелігійної боротьби, відсутність у профільних пам’яткоохоронних структур важелів впливу на впровадження в життя наявних законів. Також привертає увагу невідповідність нормативно-правової бази вимогам часу й нехтування представниками владних структур законодавчими нормами. Після 1930 р. зміна підходів у музейній сфері посилила ідеологізацію сфери збереження надбань минулого. З’ясовано, що пам’яткоохоронці намагалися чинити опір беззаконню, однак загалом ці спроби виявилися марними. Поступово посилювалася роль РСФРР загалом та Москви зокрема як загальносоюзного центру й у сфері збереження надбань минулого. В УСРР до кінця 1933 р. пам’яткоохоронна робота була фактично паралізована.

The article deals with the trends that led to significant changes in the sphere of protection of historical and cultural heritage in the period 1928–1933. In particular, the influence of the anti-religious policy of the Soviet government, «Great Break» and the further ideologization of socio-political life on the monument protection sphere is traced. Attempts of relevant structures and their employees to protect the monuments of past epochs from destruction are examined. The purpose of the article is to identify main trends in the formation of the relevant legal framework in the context of the all-Soviet processes during 1928–1933. Research methods. To achieve this purpose, the problem-chronological, historical-comparative and historical- genetic methods were used. The methodological basis of the article is consisted in the multidisciplinary approach. A culturological approach was used to study «The Historical Policy», and the comparative legal analysis was used in studying the legislative acts. The scientific novelty of the article is that the materials studied in it allow to better analyze the preconditions for the emergence of crisis tendency in the monument- protection sphere of the Soviet Ukraine (1928–1933) through the studying of «The Historical Policy » and determines the features of monument-protection activities in the Soviet Ukraine in the all-Soviet context. The conclusion. Attempts to preserve the monuments of previous epochs at legislate level were unsuccessful due to a number of factors. In particular, the tendency to intensification of the anti-religious struggle and the lack of the opportunities to influence on the implementation of existing laws by the relevant monument-protection structures had the most pronounced negative impact on the condition of the heritage of the past epochs. The inconsistency of the legal framework with the requirements of the time and the neglect of the legislative norms by the representatives of the power structures were particularly noticeable and become disastrous for the monument-protection sphere. After 1930, the change of approaches in the museum sphere intensified the ideologization of the sphere of preservation of the heritage. It was found that the guards tried to resist the lawlessness, but in general these attempts were in vain. The role of the Soviet Russia and Moscow as an all-Soviet center in the monument-protection sphere gradually increased. By the end of 1933, the monument-protection activities in the Soviet Ukraine become practically paralyzed.
