Правовий нігілізм в Україні: випадковість чи закономірність?

Abstract

Досліджено правовий нігілізм як специфічний феномен, який впливає на процес формування правової держави, а також наслідки правового нігілізму для всіх верств сучасного українського суспільства. Розглянуто його історичні витоки, які впливали на процес формування світогляду та правової культури. На основі аналізу цього явища зроблені висновки щодо шляхів подолання правового нігілізму в Україні. Особливу увагу приділено прогалинам у законодавстві. Розглянуто поняття «нігілізм» із психологічної точки зору.

Исследовано правовой нигилизм как специфический феномен, который влияет на процесс формирования правового государства, а также последствия правового нигилизма для всех слоев современного украинского общества. Рассмотрено исторические истоки, которые влияли на процесс формирования мировоззрения и правовой культуры. На основе анализа этого явления сделаны выводы относительно путей преодоления правового нигилизма в Украине. Особое внимание уделено пробелам в законодательстве. Рассмотрено понятие «нигилизм» с психологической точки зрения.

Legal nihilism is relevant at all times but nowadays it flourishes as never before. At present the issue of legal nihilism is not explored fully. Meanwhile, in connection with the development of the modern social order, there is an increasing manifestation of legal nihilism. Today there is a clear situation where the laws are openly ignored, violated, not enforced, not valued, not respected. The article covers the following aspects of the concept and definition of the legal and social nature of legal nihilism, the consideration of the essence of legal nihilism, definition and analysis of legal nihilism form as the negative properties of the domestic legal sphere. The purpose of this work is to study and to consider ways to overcome the legal nihilism. Tasks are defined by the context of the review and study the issues outlined above legal nihilism as a whole. The article investigates legal nihilism as the specific mobile phenomenon, which influences the process of forming of the legal state, and also consequences of legal nihilism for modern Ukrainian society. It is considered historical sources which influenced on the process of forming the world view and legal culture. On the basis of analysis of this phenomenon there were done conclusions regarding ways of overcoming legal nihilism in Ukraine. The special attention is spared blanks in legislation. It is considered basis of research of «nihilism» from the psychological point of view.
