Article is devoted to research the place and role of the category “sovereignty” in constitutional law of Ukraine. Sovereignty is a fundamental category that has dominated a number of political and legal concepts and categories as follows: «government», «form of government», «state power», «public functions», «state apparatus»,
«citizenship» and so on are based on its basis. Thus, sovereignty as fundamental constitutional and legal principle makes the whole system of principles and content of the institutions of constitutional law. In the field of constitutional law, this category serves as a basic principle which all basic institutes of constitutional law are based on: the foundations of the constitutional order, public authorities (including the Institute of the President, the legislative, executive and judiciary, constitutional justice, prosecutors, etc.), democracy (direct and representative democracy forms) human
rights (especially in the institute of citizenship), name of the state, official language, territorial organization, local government and others. It was studied the relationship
between category “sovereignty” and the general principles of constitutional law.
These principles include the principle of publicity, priority, universality, scientism, democracy, active efficiency, continuity, consistency, programmaticy. The idea of
sovereignty in the triple Unity (state, nation, national) acts as a basic fundamental principle of democratic organization of constitutional law. State sovereignty
defines the basic nature, content, direction and forms of constitutional and legal regulation. Firstly, considering the fact which is concentrated expression of the
value of a sovereign state as one that is able to provide harmony in society. Achieving this idea is the main goal, the task of constitutional and legal regulation. Secondly, the principle of sovereignty subordinates all other general and particular (special) principles
of constitutional law. The principle of sovereignty is fundamental nature for principles of these institutes as well as general principles of constitutional law and carries of subordination role. |
