Особливості правового регулювання публічних закупівель в умовах воєнного стану та післявоєнного періоду (за матеріалами наукового повідомлення на засіданні Президії НАН України 29 червня 2022 р.)

Abstract

У статті окреслено особливості правового регулювання публічних закупівель в умовах воєнного стану. Визначено основні напрями, за якими пропонується провести реформу публічних закупівель в Україні у повоєнний період: спрощення порядку здійснення публічних закупівель, адаптація вітчизняного законодавства до вимог ЄС у цій сфері, подальша діджиталізація публічних закупівель, а також стратегічне використання публічних закупівель для досягнення відповідних цілей за різними напрямами державної політики. Особливу увагу приділено стратегічному використанню публічних закупівель, що має становити основу післявоєнної відбудови України. Наголошено на необхідності розвитку сталих публічних закупівель. Узагальнено результати попередніх досліджень щодо необхідності запровадження «зелених» та соціально відповідальних публічних закупівель (за напрямом забезпечення зайнятості населення) у контексті процесів відбудови. Запропоновано розробити та затвердити Національну стратегію публічних закупівель, а також стратегії розвитку публічних закупівель відповідних областей у зв’язку з Планом відновлення України.

The present article provides an overview of the peculiarities of legal regulation of public procurement under martial law. The main directions in which it is proposed to reform public procurement in Ukraine in the post-war period are identified: simplification of the public procurement procedure (reduction of time limits, increasing of the thresholds, etc.), further digitization of public procurement (introduction of electronic invoicing, smart contracts etc.), harmonization of domestic legislation with the EU requirements (development of the legal framework for the public procurement for innovations, protection of the public procurement market, etc.), as well as the strategic use of public procurement to achieve horizontal aims within the defined directions of state policy (environmental and social protection, etc.). Special attention is dedicated to the strategic use of public procurement, which is still not fully implemented and should form the basis of the post-war reconstruction of Ukraine. The need to develop sustainable public procurement was emphasized. The results of previous research on the need to introduce “green” and socially responsible public procurement (in the direction of ensuring employment of vulnerable groups of population, including the internally displaced persons and exservicemen) in the context of reconstruction processes are summarized. It is proposed to develop and approve the National Public Procurement Strategy, as well as Public Procurement Development Strategies of individual regions in connection with the Recovery Plan of Ukraine. It is emphasized that National Strategy should conceptualize the strategic approach to public procurement.
